Why Rocket Lab Is Protesting NASA’s Mars Communications Contract
NASA picked Blue Origin for a $700 million Mars communications orbiter contract. Losing bidder Rocket Lab has filed a formal protest, putting the award before the Government Accountability Office. This article explains the contract, the disputed procurement language, and what is at stake.
A $700 Million Award
Under the contract, Blue Origin is expected to build a spacecraft, launch it, and operate a communications network around Mars. It is the first time NASA has used a fixed-price contract to select a US company to build, launch, and operate a network around another planet. That makes the award a departure from how NASA usually pays for complex deep-space infrastructure.
The contract is also tied to a broader goal. Mars Sample Return needs reliable communications between Earth and Mars, and the new orbiter is meant to support an end-to-end mission of that kind.
The Disputed Wording
Rocket Lab announced it is protesting NASA’s decision. At the center of the dispute is language linking eligibility to prior work: the orbiter had to be selected from among US companies that received funding in fiscal year 2024 or 2025 for commercial design studies for Mars Sample Return and had proposed a separate, independently launched Mars telecommunication orbiter supporting an end-to-end Mars sample return mission.
Ars Technica reported that, according to sources, the “end-to-end” wording was intended to favor Rocket Lab and its proposed telecommunications orbiter. NASA nevertheless selected Blue Origin.
Why the Review Matters
NASA has not yet publicly released a source selection statement, the document that explains the technical rationale for the award. Without it, the reasoning behind Blue Origin’s win remains unclear. The Government Accountability Office will review Rocket Lab’s protest.
The outcome matters beyond this single contract. The award is a first test of fixed-price procurement for interplanetary communications, and a decision to uphold or overturn it could affect how NASA buys similar infrastructure in the future. The protest also adds uncertainty to Mars Sample Return planning, which will depend on exactly the kind of relay capability this orbiter is meant to provide.
